NOTE: BY USING OUR WEBSITE FOR BOOKING ENQUIRY AND/OR SENDING US YOUR DEPOSIT OR ANY SUBSEQUENT PAYMENT TOWARD YOUR TOUR PRICE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE TERMS OF SERVICE BELOW.
Responsibility
Clients are responsible for selecting a tour suitable for their athletic ability, informing us of any medical or dietary restrictions, and obeying all safe biking rules. Thailand Treks (TT) reserves the right to decline or withhold service to any person who, for physical or other reasons, is deemed unfit for the tour. TT is not responsible for cancellations or amendments due to acts of nature, civil unrest or inclement weather. Every care will be taken to respect your luggage at all times. However, TT is not responsible for damage, loss or theft of your personal belongings.
Your Responsibilities
TT is committed to making your tour as rewarding and fun as possible. But we require your help to do so. For example, we rely on you to provide us with necessary personal information (age, passport details, allergies, etc.) and travel preferences (type of bed, dietary needs, etc.) so we can arrange the right tour for you. We also ask that you respond to our questions in a timely manner so as not to delay the planning process.
Our Responsibilities
TT recognizes the faith and trust you put in us. We will do our utmost to create and deliver the perfect tour for you. Our aim is to provide you with a reliable service. We will respond to your messages promptly and will keep you informed. If at any time you have questions or concerns, we ask that you let us know immediately so we can address them.
A deposit of 30% per person is required for the tours within 2 weeks of making the reservation. The remaining amount must be credited to our bank account no later than 48 hours before departure of your tour. The (deposit) payment can be done via Paypal or via credit or debit card. (Final) payment has to be made in cash at the start of the tour to the guide or the representative of TT in case of self-guided tours.
The tour price is per person based on double occupancy and includes those items mentioned in the itinerary. Single room requests are subject to supplemental charges and must be requested at the time of booking.
Insurance
TT strongly recommends cancellation and accident insurance to prevent any losses in case of illness, accident or otherwise. It is the responsibility of the client to apply directly to the insurance company in their own country. Please purchase tour cancellation insurance in case an illness forces you to cancel or depart early from a tour. Our cancellation fees are not negotiable.
TT does have local accident insurance for each participant of their tours.
Cancellations
In the event that you cancel your participation of the tour, TT has the right to keep the following:
Cancellation of tours: for cancellations made more than 14 days before your booking date your deposit will be refunded after deduction of possible payment fees. If you cancel within 2 weeks of your booking date the deposit will not be refunded.
Cancellations must be submitted to TT in writing. No refunds are made for unused portions of the tour once it has begun.
Cancellations by us
In very rare cases it may be necessary for TT to cancel a tour. In the event of cancellation, a full refund of the deposit will be sent to the client and this constitutes full settlement. TT is not responsible for other expenses incurred such as prepaid hotel reservations or non-refundable airline tickets. Scheduled guided tours with low enrollment may be subject to cancellation or changes. Registrants will receive a notice and full refund or option to move to another scheduled date.
Accommodations
Our accommodations are in nice small hotels and guesthouses. We will do everything in our power to secure your lodgings in our first-choice hotels, but it may not always be possible, especially if you are booking during a particularly busy season. In that case, we will secure your lodgings in comparable hotels.
Limitation of Liability
To be eligible to take a TT tour, participants must accept the risks of travel, set out in these Terms of Service, and assume full responsibility for any loss, injury, death or damage to them, their family or their dependents or property arising in connection with their participation, or the participation of their family, in the tour. Participants must have their own insurance appropriate to their needs and the needs of their family or dependents in respect of such loss, injury, death or damage. The cost of all TT tours is based on participants agreeing to these Terms of Service and in particular this Limitation of Liability,
Release and Indemnity
As TT is acting solely as an agent of you with respect to all accommodations, meals and other arrangements, in consideration for participating in the tours, participants agree not to sue TT, its employees, directors, successors, agents and assigns in respect of, and forever release them from, all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with the tour and the actions of any third-party service providers—including, without limitation, permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property—in each case even if caused in whole or in part by the conduct, including the negligence, of TT, except where such loss, injury or damage is caused by reckless or fraudulent conduct on the part of TT or their employees, guides, shareholders, officers or directors, in which case the participant retains the right to sue only TT in respect of that conduct. Participants further agree that they will indemnify and hold TT harmless in respect of any claims arising in connection with the tour made by
In addition and without limitation, TT is not responsible for any injury, loss, or death, or damage to property in connection with the provision of any goods or services whether resulting from, without limitation, to acts of God or force majeure, weather, quarantines, illness, disease, acts of war, civil unrest, insurrection/revolt, animals, labor unrest, including strikes, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of means of transportation or travel delays, travel advisories or warnings.
In further consideration for participating in the tour, participants agree that TT, or their designate, may use any photographic or film records of the tours for promotional and/or commercial purposes, without any remuneration to the participant. The participant agrees to assign all right, title and interest they may have in or to any media in which their name or likeness might be used to TT.
Participants agree that TT is the trustee of the respective rights of TT under this Limitation of Liability, Release and Indemnity, which will apply to a participant’s tours with TT, and any transfer of a reservation to another tour.
Governing Law
These Terms of Service and any claim, controversy, dispute or cause of action (whether in contract or tort or otherwise) based upon, arising out of or relating to these Terms of Service and the tour hereby reserved shall be governed by, and construed in accordance with, the law of the Kingdom of Thailand.
Modifications
TT reserves the right to modify the Terms of Service at any time without prior notice. Any changes will become effective immediately upon publication to the website, usage of the website and services post-change constituting acceptance of the modified Terms of Service. If the modified Terms of Service are not acceptable to you, your only recourse is to cease using the website and services.
These Terms of Service and this Limitation of Liability, Release and Indemnity are binding upon all members of the participant’s family, dependents, estate, heirs, successors and legal personal representatives.
